    From Threat to Recovery: Cyber Insurance & Incident Response Trends

    The presentation will dive into the growing landscape of cybersecurity risks and threats, including the continued rise of ransomware incidents across Canada. The presentation will cover regulatory updates, such as Quebec’s Bill 25, recent class action lawsuits related to data privacy breaches in Quebec and common law provinces, and the critical role of incident response. Additionally, it’ll explore the essentials of cyber insurance, a typical “claims process” and will dive into trends in the cyber insurance industry. This session is a must for anyone navigating cybersecurity, privacy, or risk management!

    Nathalie David, Partner, Clyde & Co

    Nathalie David is a cyber specialist with a focus on data protection matters, including data breaches and compliance, as well as technology related claims.

    Nathalie oversees both the cyber insurance coverage and incident response teams at Clyde & Co’s Montréal office.

    She assists insurers and insureds in evaluating data breaches, privacy issues and cyber claims in a variety of sectors, from issues in relation to notification to customers, restoration of data and quantification of loss. Nathalie works with an established network of experts globally who can assist when required.

    Nathalie has provided legal counsel to a variety of actors in the insurance industry for more than 20 years. She combines pragmatism with her in-depth knowledge of all facets of the industry, from insurance coverage to product distribution and regulatory compliance. She understands her clients’ operations and helps them bring their business projects to fruition.

    She also counsels clients on insurance policies and assists with product development, distribution issues, and has undertaken large-scale product line reviews for insurers. She also advises insurers and other actors in the insurance sector on federal and provincial licensing, compliance matters and works collaboratively with regulators to ensure her clients meet their objectives.

    Nathalie’s experience also includes advice to professional firms on mandatory insurance requirements, insurance, and risk transfer arrangements, as well as the drafting of Master Service Agreements with their large institutional or corporate clients.

    Fluent in both English and French, Nathalie is a frequent speaker on insurance, cyber risks and data privacy. She also taught insurance law at the Law Faculty of McGill University.

    Geneviève Westgate, Associate, Clyde & Co

    Primarily practising in the privacy and cybersecurity fields, Geneviève works in Clyde & Co's Montreal cybersecurity incident response team and also advises clients on cyber insurance coverage.

    As privacy counsel (“breach coach”) Geneviève provides legal counsel to her clients in the event of cybersecurity incidents involving data and/or privacy breaches. In her practice, Geneviève advises clients on a wide range of cyber incidents from ransomware attacks to social engineering frauds, across multiple Canadian jurisdictions.

    As coverage counsel, she assists insurers and insureds in navigating cyber insurance claims in a variety of sectors, including manufacturing, technology and professional liability. She also advises on breach response services, data restoration and evaluation of business interruption loss. 

    Geneviève joined Clyde as an associate in 2023, after having gained experienced as an articling student practising in business law at a full-service national law firm. In addition, she has experience working in the aerospace and pharmaceutical industries.

    She obtained her Bachelor of Civil Law and her Juris Doctor at McGill University. During her academic journey, Geneviève was a member of the Law Student Association and an associate editor of the McGill Journal of Sustainable Development Law. Moreover, she was a case worker at the McGill Legal Information Clinic.

    Described as determined, organized and empathetic, she draws on her skills to build strong interpersonal relationships with co-workers and clients. Geneviève is a member of the Canadian Bar Association and the Young Bar of Montréal.

    In her spare time, she enjoys running, both in the city and on trails. 

    Othmann Layati LL.M., CIPP/C, Regional Manager, VP, Claims, Quebec Aon

    In addition to his role as VP and Regional Manager for claims in Quebec, Othmann is responsible for the handling of complex financial lines claims at Aon.

    Othmann started his career in private practice as a litigation counsel, focusing mainly on commercial litigation and white-collar crime. He later joined a global law firm focused on insurance where he developed a strong interest in coverage work. Prior to joining Aon in 2021, Othman has occupied the position of Cyber Claims Managers at a Lloyds specialist insurer.

    Othmann has also developed a strong interest and expertise in cyber insurance as well as privacy laws and holds several accreditations with the International Association of Privacy Practitioners.

    Jade Buchanan is a partner in McCarthy Tétrault in Vancouver. His practice is about the risks and rewards of cutting-edge technology, particularly on cybersecurity and privacy.     RECORDING: CAN-TECH 2024 Spring Conference: Peeling Back to Basics: Technology Contracts

    The CAN-TECH Spring Conference is back and, following last year's success, will focus on discussing practical tips and tricks for junior to mid level technology lawyers to apply in their practices. The event was held from coast-to-coast – starting in Vancouver and ending in Halifax – with five offices (Vancouver, Regina, Toronto, Montreal, and Halifax) each hosting one live panel and participating in the other panels via Zoom. The one-day, pan-canadian program, with hybrid in-person and webcast sessions, will see panels across five satellite locations discuss a range of topics, including drafting and negotiating strategies and pitfalls to look out for in technology contracts.

    The hope was that the attendees would leave the conference feeling more confident and comfortable in their understanding of technology transactions, the contracts, and the issues that often come up in them. Based on the expertise the panelists shared, and the accompanying materials, mission accomplished.

    Justine Gauthier, General Counsel & Head of AI Governance, Mila 

    Justine Gauthier is the General Counsel & Head of AI Governance of Mila, a prominent artificial intelligence research institute at the intersection of industry, academia and government, where she also acts as Privacy Officer and Corporate Secretary. A leading voice on the emerging legal and ethical issues surrounding artificial intelligence, Ms. Gauthier is deeply involved in the Canadian innovation ecosystem, and sits on the boards of Front Row Ventures, AInBC, and the Canadian Technology Law Association.

     Dorian Morrison, Senior Associate, McCarthy Tétrault LLP

    Dorian Morrison is a senior associate in McCarthy Tétrault’s Business Law and Information Technology Law groups in Vancouver. Dorian regularly advises clients, both in the public and private sectors, on complex commercial transactions including technology procurements, technology-based outsourcings, cloud agreements and other commercial transactions.

    Dorian has been seconded to two different national organizations in the United Kingdom allowing her to work alongside the in-house legal, procurement and sales teams.

    Dorian obtained her Bachelor of Commerce degree from the University of Calgary in 2011 and her Bachelor of Laws degree from the University of Leicester in 2014. Dorian completed her legal training in the United Kingdom and became a member of the Law Society of England and Wales in 2017. Prior to joining McCarthy Tétrault LLP, Dorian worked at an international law firm in London, UK where she practiced in the commercial and IT group.
